By the same logic, Brother-Captain Tycho, Blood Angels captain of the 3rd Company, shouldn't still be in the Blood Angels codex.

He was absolutely, and without doubt killed, but they (GW) left him in the codex because he's a popular character and they didn't want to see their sales (of White Dwarf I guess) drop by removing him.

From the dark angels codex:
"Belial was struck down, wounded almost unto death..."

and then goes on to say:
"The wounded Belial led the Dark Angels, outnumbered thousands to one, stubbornly fighting to disrupt Ghazghkull's plans..."

So no, he was wounded but not killed.

Also orks lost that battle apon the arrival of the remainder of the chapter
