Well, the latest argument to devleop, has been based around that pesky Avatar again....
The Eldar player wanted to put his Avatar inside a Wave Serpent, rush him up the filed and the big molten metal god then jump out and smack everyone.
Now the absurdity of a molten living god, patiently sitting inside vehicle rumbling up the battlefield aside; can it be legally done?
I can't find any restrictionsin the rules to say it can't be done.....??

No, it can't be done. Pg. 66 BRB "A transport may carry a single infantry unit and/or any number of independent characters (as long as they count as infantry).....
Yeah, your friends is absurd to think that an Avatar can simply zoom around the battlefield in a Wave Serpent. The page reference above is correct, and the statement that you require is the following:
"Only infantry models may embark in transports (it is worth specifying that this does not include jump infantry), unless a Codex book states otherwise."
One such exception to be taken into account are Tyranid Mycetic Spores, as it actually states that a single monstrous creature may be transported.
So in answer to your question, no, your Avatar may not, because it is not infantry, and there is no rule in the Eldar codex saying that it may be.

Its probably worth noting here that Monstrous Creatures follow the same rules as Infantry (page 51) and perhaps this is where the confusion arose from in allowing Infantry onto transports.
But what you need here is the classification of the unit type in order for the transport to accept them, and as already mentioned its a no go.
