First some background.
Alpha Legion armies may include Daemon packs but only cultists may carry the icons for them.
Page 40 of the CSM codex.
And the only mark the Alpha Legion can take is Chaos Undivided.
That much seems clear and simple.
However, here's something a bit different.
A unit or retinue of Chosen with the Mark of Chaos Undivided may select a special icon...

Now my plan was originally to have a lot of MoCU cultists in an Alpha legion list, buy a squad of Chosen and give the the special icon of Chaos Undivided which would make all the scum within 6" of it fearless.
Page 18 of the CSM codex.
I wasn't planning on using the special icon for daemon summoning at all.
However, as it stands I'm not sure if I am legally allowed to take that icon in an Alpha Legion force since it remains an icon, if a special one.
Hopefully that made sense.

This is one of them.
I can see your logic in that it has been FAQed that Summoning Packs is Cultist-only.
IMO, this was intended, originally, to limit the number of summoning Units in an AL force.
I get the sense that 'Special', 'Daemon', Undivided', 'Personal'. etc. Icons were added later.
But, as you point out, it remains an Icon and as such falls under BoC provision. Pity.
