There are a lot of confusing rules in 40K and obviously lots of special rules in codexes (codexi?), but I've found lots of people mess up some regular rules a lot. Since I do some play by e-mail this can extra annoying. Anyway in my experience these are the most messed up rules.
Target priority tests
Handling obscured vehicles (p69)
Forced disembarcation even when transports survive a penetrating hit
Handling independent characters in close combat (also trying to split attacks from a single model),
Leadership modifiers for moral checks
Any others you find people mess up all the time?
That would be "codicies"
Anywho, my friend always rolls on the wrong tables for penetrating/glancing hits. it gets quite funny, because the last time he did it one of his bikes supposedly blew up a land raider. I don't actually play 40k, but my i'm starting now.
MIxed armour and mixed toughness. 9/10 people (including GW staff) mix this up.
Also, the amount of gifts allowed on a 40K Chaos HQ.
The Bezerker Glaive and speed/flight is also a great one.
Yeah. Like Karmoon said, no-one can seem to make a legal Chaos Lord nowadays.
Other than that, most rules are pretty well known around here.
I often see people who miss the "...upgrade for +5 points and then have access to the Armoury" thing, and think every model in their squads of whatever can take wargear and whatnot. That and Ld modifiers, and taking morale tests after shooting.

The rule I most commonly mess up in WFB is Fast Cavalry.
I've done it in so many different ways, but usually not at the same time
Thinking they can auto-rally if they voluntarily fled the turn before. (Wrong!)
Thinking they can move and shoot the turn they rally. (Wrong! They can merely move)
Thinking they can only shoot to the front. (Wrong - 360 degrees)
Thinking they can't be stopped from marching by the proximity of enemy troops. (Wrong!)
Thinking they don't remove rank bonus if they charge the enemies flank (Wrong!)
Thinking they skirnish (Wrong!)
Each time I think I've got my head around fast cavalry, I do something else wrong.
I'm beginning to think it isn't the way the rule's written, it's me!
