if i have a warboss who has joined a nob unit that has 1 model remaining in it. the unit is shot with a laz cannon or a missile or some weapon that would instand kill the nob but not the warboss, is it legal to use the warbosses toughness for the to wound purpose but alocate the wound to the nob instead

the wound has to be allocated to one or the other, whichever you chose must use its SV T and W for that wound, you cannot share the stats out between the unit
the rule book state majority toughness or highest if equal and majority save or highest if equal. so my question again.
if there is a weapon that could instant kill a nob, but not a ork warboss. the ork warboss and the single nob have formed a unit, which was shot and wounded with this weapon. would i be able to use the warbosses toughness to take 1 wound and avoid the instant kill then put the wound on the nob.
The rules for toughness are that if there are equal numbers of models in a unit with different toughness, use the higher value. However, if the wound is allocated to a unit with T such that it'll be instantkilled, then it is indeed instant killed, even if you used a higher T to roll-to-wound.

I am pretty sure I know what you are asking, so I will try to lay out the scenario. First, since there is no majority toughness in the squad, ie one with 4 and one with 5, you would use the toughness 5 for the to wound rolls against the squad. Then, once wounds are determined, you would allocate onto the models you wanted hit, ie the nob or warboss. Now, if you say got hit by a strength 8 weapon, then the strength 8 would be compared to toughness 5, then once it wounded, if you put it on the warboss, he would take one wound since it isn't double his toughness, but if you put it on the nob he would die, because the shot is double his toughness. So, the major answer to your question, is while you use the t5 for the wound roll, when the hit is allocated, then you would compare strength to toughness for instant kill.
