with the release of the new codex ar gue'vesa still legal.
If they were still legal, I'd imagine that they would've been put into the new codex. After all, the Rail Rifle was added and I think that that came out in the same Chapter Approved as the Gue'vesa

Typically Chapter Approved are still allowed after a new codex as long as they don't specifically break any rules. But, some of them may have to be modified to fit within the new unit guidlines. I don't play Tau, but I know that the tyranid Chapter Approved special characters are still allowed with the new codex.
I do not criticize. I do not offend. All I offer is my opinion which means only as much as you make it.
That's different because the Chapter Arppoved article for Tyranid Special characters came out after the new Codex.
In this case the Human Auxiliaries came out before the new Codex. If they are still on the web and you want to use them I would just ask your opponent before you bring them.
You may need to default to House Rules.
I wouldn't have a problem with them. It's not like they are real poweful and they add flavor to the army.
gue'vesa suck. If someone has a problem with you using them, they have issues.

I would consider them to still be legal as they are clearly marked as "Chapter Approved". I plan on fielding a unit or two once I get my Tau army up and running. They are cheap (12 men for 72 pts.) and for 20 pts. you can upgrade one model to a Gue'vesa'ui with a Markerlight. They would make good cannon fodder for "the greater good"! You can use them to slow down the enemy advance or simply light up a unit with the Markerlight. They also have a better WS than Firewarriors, who you would want to keep out of assault anyway.
