is it?????? i thought it was a super heavy type of creature, nid version of super heavy tanks...therefore i think you need your oppenents permission to use a malefactor, i could be wrong but thats what i have allways thought about the big nid nasties like malefactor etc

Because the rules for the Malefactor were created with the CDR, I would also say that permission required. After all, having a "transport" does have a rather drastic effect on the Tyranids...
"The meat things seek to destroy ourselves. They hunt us as we hunt them but they are weak and uncertain. The inferior flesh will be entirely destroyed, all biomatter consumed. Ourselves will fight to the last, all weak flesh must be devoured."

It says right on page 78 of CA'04 that all the Bio-Monstrosities require your opponent's permission to use. This includes Malefactors, Expocrines, et. al.
And the lands shall burn from horizon to horizon.
Just as the sun cannot be prevented from rising,
Neither can the inevitable be halted or avoided.
Hive Fleet Infernus shall scorch all worlds in its path.
