I read in the chapter approved that the tau can't use the kroot mercenary army. This doesn't make a lot of sense because they already use kroot in the codex. Why can't they use the additional kroot types as well???
But I believe the Kroot mercs are the Kroot that are located outside the tau system that have come into contact with other races and evolved from consuming their flesh. The Kroot available to the Tau are closer to home and have evolved less due to less contact from outsiders.
I think Tau should have access to at least one or two units of the new mercs, but I think it would unbalance the army a bit.
I forget where, but you can equip your shapers with stuff from the wargear list... So hello meltas/eviscerators.

Also, I belive the reason that the Tau cant use the new kroot units are becuase the Tau are not supposed to know about the kroot working for other armys and fighting on other planets. As far as the Tau are concerned the kroot are only supposed to work from them.
At least thats my impression from reading the Chapter Approved the new units where in. I think I saw that in the 2003 however, not the 2004. None of my friends have 2004 yet so I havent seen it.
