I foresee a very inconclusive battle here. However, the first army has just a bit more firepower, so I vote them. Afterall, every token may be contested, but victory points are still included.

I vote Tau

Seriously, I vote The first Tau army

Also, because of the superior variety, I vote them for fluff

I'd say the first list, because I think it has more anti-tank, and there are plenty of tanks in each list.

First list.

The lists look almost identical, but the 2 hammerheads and broadside give the first list an advantage, and I can see whoever has more hammerheads is going to win this fight.

I vote for the first list

First list

I have think it will be very effective near the end of the game, using its firepower to clear a space for it to claim the objective.

A vote for Tau is a vote for the greater good!

In future to avoid this situation, could there be a no identical armies play each other rule? swop some opponents randomly or something?

I don't see why we need such a rule, after all if two opposing armies of the same faction clash, what better way to determine which is better and which more deserves to pass on to the next round?

I agree with Addoran on that.
I also cast my vote in with the First List, again for reasons already stated.:)
